Pretrial Diversion (PDP) is a one year program sponsored by the Johnson County Prosecutor’s Office which is designed to help people whose exercising of poor judgment resulted in them being charged with a misdemeanor criminal offense. PDP allows them the opportunity to avoid having permanent criminal conviction if they successfully complete the terms of the program.
The specific requirements will vary by what a person is charged with, but can include things like community service, evaluation for substance abuse or anger control issues, paying restitution or obtaining a valid driver’s license. All participants must pay the $330.00 ($330.50 for driving offenses) program fee in addition to the cost of any additional terms like the ones mentioned here.
The program fee of $330.00/$330.50 must be paid at the time of signing the agreement. Any additional fees must all be paid by the compliance date listed on your agreement.
The $330.00 ($330.50 for driving offenses) program fee and any restitution must be paid by certified check or money order made out to: CLERK OF JOHNSON COUNTY or in cash. Restitution may be: (a) paid in person at Court Fines, 1st floor of the Johnson County Courthouse, Franklin, IN; or, (b) mailed to Clerk, Restitution, P.O. Box 368, Franklin, IN 46131. Fees for treatment would be made directly to the provider. Please be sure to list your cause number on any payments made via US Mail.
Depending on the circumstances which caused you not to fulfill all the terms, the penalty can range from being given additional time to complete your terms, or the agreement being set aside by the court. The decision to extend or revoke the agreement would be in the sole discretion of the deputy prosecutor handling the case.
